Terms of Use

Welcome to Senson. These Terms of Service ("Terms") are an agreement between you and Sensa Something Inc. ("Senson," "we," "us," or "our").

These Terms apply to:

• The Senson mobile application (the "App");
• The Senson website(s) (the "Website");
• Any firmware, software, or connectivity used with Senson-branded devices (the "Devices"); and
• Any content, features, or services offered on or through them (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of a company or organization, you represent that you have authority to bind that entity, and "you" includes both you and that entity.

IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER.

1.1 Age Requirements

The Services contain erotic and adult-oriented content. You may use the Services only if:

• You are at least 18 years old; and
• You are legally permitted to access adult content and sexual wellness products in your jurisdiction.

If you are under 18, you must not use the Services.

1.2 Registration and Account Information

You may need an account to access certain features. You agree to:

• Provide accurate and complete information;
• Keep your information current;
• Not create an account on behalf of someone else without their consent;
• Not impersonate any person or entity.

We may suspend or terminate accounts at our discretion where permitted by law.

1.3 Account Security

You are responsible for all activity on your account. You agree to:

• Keep your login credentials confidential;
• Notify us immediately of unauthorized access;
• Log out when using shared devices.

Senson is not liable for any loss resulting from your failure to secure your account.

1.4 Service Practices and Storage

We may establish general usage limits, including limits on:

• Storage capacity;
• Content retention periods;
• Maximum session frequency;
• Bandwidth usage;
• Inactive account deactivation.

We may delete or refuse to store content. You are responsible for backing up your content.

1.5 Communications

By providing your contact information, you consent to receiving:

• Account notices and updates;
• Security alerts;
• Administrative messages.

Where required by law, you may opt out of marketing messages. Administrative messages may still be sent.

Senson grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Install and use the App;
• Access the Website;
• Use the firmware and software necessary for Devices;
• Use the Services for your personal, non-commercial use.

All other rights are reserved by Senson.

You are responsible for all content, prompts, interactions, and uploads ("User Content") you submit through the Services.

You agree not to use the Services to submit, generate, or request content that:

3.1 Involves Minors

• Depicts or sexualizes individuals under 18;
• Depicts characters who appear under 18;
• Includes age-regressed or "young-looking" sexual content;
• Includes grooming or exploitation of minors.

3.2 Non-Consensual or Harmful Sexual Content

• Non-consensual sexual acts, coercion, or forced scenarios;
• Content that romanticizes or promotes sexual violence;
• Non-consensual sharing of intimate materials.

3.3 Illegal or Dangerous Activity

• Instructions for illegal activities;
• Human trafficking or exploitation;
• Excessive or sadistic violence;
• Terrorism or violent extremism.

3.4 Harassment or Hate

• Harassment, bullying, or threats;
• Hate speech based on protected characteristics;
• Defamatory or knowingly false statements.

3.5 Privacy, Security, and IP Violations

• Uploading or requesting personal data of others;
• Impersonating others;
• Uploading malware or malicious code;
• Infringing third-party intellectual property.

3.6 Real-Person and AI Misuse

You may not:

• Create deepfakes of real individuals without consent;
• Create explicit content involving identifiable real people without consent;
• Upload recordings or images of real people without permission.

3.7 Prohibited Advice and Sensitive Use

You may not rely on the Services for:

• Medical or mental health advice;
• Legal, financial, or tax advice;
• Emergency or crisis situations;
• Automated decision-making affecting legal rights.

3.8 Technical Misuse

You may not:

• Reverse engineer or attempt to extract source code;
• Circumvent access controls;
• Use scrapers, bots, or automated tools;
• Rent, sell, or sublicense the Services.

We may take action if content violates the law or these Terms, including:

• Removing or limiting content;
• Suspending or terminating accounts;
• Restricting Device connectivity;
• Reporting illegal activity to authorities.

We use automated and manual systems to detect potential violations.

You may report content via in-app tools or support channels.

5.1 Nature of AI Content

AI-generated content may be fictional, inaccurate, or unexpected. You acknowledge that:

• Senson does not review or verify all AI outputs;
• Generated content may be offensive or incorrect;
• You are responsible for your interactions and interpretations.

5.2 No Professional Advice

Generated content is for entertainment and wellness only.

It does not constitute:

• Medical advice;
• Mental health or psychiatric advice;
• Legal or financial advice;
• Crisis or safety-critical instructions.

Seek qualified professionals for real-world advice.

By using Senson Devices, you agree to:

• Follow all safety instructions and manuals;
• Use Devices only for consensual adult purposes;
• Stop using Devices if you experience pain or discomfort;
• Use only compatible chargers and accessories;
• Avoid modifying hardware or firmware.

Senson is not responsible for injuries or damage resulting from misuse.

7.1 Your User Content

You represent that you own or have rights to your User Content.

You grant Senson a worldwide, royalty-free, transferable, sublicensable license to:

• Use, store, reproduce, modify, adapt, and distribute your User Content;
• Provide, operate, and improve the Services;
• Enforce policies and comply with law;
• Train and enhance AI models, where permitted by our Privacy Policy and your settings.

You retain ownership of your User Content.

7.2 Generated Content and Characters

As between you and Senson:

• You retain rights to fictional characters or storylines you create;
• Senson has the right to use Generated Content and your characters to operate, improve, and maintain the Services.

Senson does not owe compensation for such use.

7.3 Senson IP

All intellectual property in the Services belongs to Senson or its licensors.

You may not use Senson's trademarks without written permission.

A valid notice must comply with the requirements of 17 U.S.C. §512(c)(3).

If you believe content was removed incorrectly, you may submit a counter-notification.

We may terminate repeat infringers.

The Services may contain links to or rely on third-party services.

We are not responsible for third-party content, practices, or policies.

Your interactions with third parties are solely between you and them.

If you purchase Services:

• You agree to pay all fees and taxes;
• Recurring subscriptions will renew automatically until canceled;
• Cancellations through app stores must follow each store's procedures.

We may change pricing with legally required notice.

We may suspend or terminate your access to the Services for:

• Violations of these Terms;
• Misuse of the Services;
• Payment failures;
• Discontinuation of the Services.

Upon termination:

• Your right to use the Services ends;
• We may delete associated content;
• Provisions that reasonably should survive (including IP, disclaimers, arbitration, liability limits) will remain in force.

You may delete your account at any time.

You agree to indemnify and hold harmless Senson and its affiliates, officers, directors, employees, and agents from any claims arising from:

• Your use of the Services or Devices;
• Your User Content or Generated Content;
• Your violation of these Terms or applicable laws;
• Your infringement of third-party rights.

The Services are provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, Senson disclaims all warranties, including:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Accuracy or reliability of AI content;
• Uninterrupted or error-free operation.

To the maximum extent permitted by law:

• Senson is not liable for indirect, incidental, special, consequential, or punitive damages;
• Senson's total liability will not exceed the greater of:
• USD $100, or the amount you paid Senson in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations; protections apply to the maximum extent allowed.

Except where prohibited by law, or where small claims court or intellectual property claims apply, disputes will be resolved through binding, individual arbitration.

You waive the right to participate in class actions or class arbitration.

Opt-Out

You may opt out within 30 days of first accepting these Terms by emailing:

• Subject: "Arbitration Opt-Out"

Arbitration procedures, fees, mass-arbitration rules, severability, and venue follow standard U.S. federal arbitration principles.

If you reside in the United States or outside the EEA:

• These Terms are governed by the laws of the State of Delaware;
• Except where arbitration applies, disputes shall be brought exclusively in courts located in California;
• You waive objections to venue or inconvenient forum.

Mandatory consumer protection laws apply where required.

We may update these Terms periodically.

We will update the "Last Updated" date and provide additional notice as required by law.

Continued use of the Services after changes become effective constitutes acceptance of the new Terms.
